Please read these Silverback Muscle Terms and Conditions carefully before purchasing or using a Silverback Muscle programme or coaching service.

1. About Silverback Muscle
Â
Silverback Muscle is a trading name of Damian Summerscales, a sole trader operating in England.
Â
These Terms and Conditions apply to the purchase and use of online coaching services and personalised training programmes provided under the Silverback Muscle name.
Â
Silverback Muscle provides online, goal-focused resistance training programmes designed to help clients build muscle, increase strength and train effectively.
Â
Silverback Muscle coaching services are available only to individuals aged 18 or over. By purchasing a programme or coaching service, you confirm that you are at least 18 years old.
Â
By purchasing a programme or coaching service from Silverback Muscle, you agree to these Terms and Conditions.
Â
Training programmes and information provided by Silverback Muscle are intended for fitness and educational purposes and do not constitute medical advice, diagnosis or treatment.
Â
2. The Silverback Muscle 6-Week Programme
Â
The Silverback Muscle 6-Week Programme is a personalised online resistance training service designed around the individual client's goals, training experience, available equipment and training schedule.
Â
The programme includes:
Â
- An initial client assessment and training questionnaire
- A personalised 6-week resistance training programme
- Delivery through the Everfit coaching app or another suitable coaching platform where necessary
- Exercise, sets, repetitions and training guidance
- Progress tracking throughout the programme
- Weekly client check-ins
- Reasonable programme adjustments where appropriate
- Programme-related support during the 6-week coaching period
- An end-of-programme review and recommendations for continued progression

Personalisation
Â
Programmes are created using the information supplied by the client. Clients are responsible for providing accurate and complete information about their training experience, available equipment, goals and relevant limitations.
Â
The programme may be adjusted during the six-week period where an adjustment is reasonably appropriate.
Â
Coaching Period
Â
The six-week coaching period begins on the programme start date agreed between Silverback Muscle and the client. The programme does not automatically begin on the date of purchase unless that date has also been agreed as the programme start date.
Â
Failure to complete workouts, provide check-in information or engage with the programme does not automatically extend the six-week coaching period.
Â
Communication and Support
Â
Support is provided for reasonable questions relating to the client's training programme during the coaching period, primarily through Everfit or another communication method specified by Silverback Muscle.
Â
Silverback Muscle aims to respond to programme-related messages within 24 hours. This is a response-time aim rather than a guaranteed response time, and responses may occasionally take longer, including during weekends, holidays or exceptional circumstances.
Â
Silverback Muscle does not provide a 24-hour or emergency support service.
Â
3. Price, Payment, Cancellations & Refunds

Price and Payment
Â
The price of the Silverback Muscle 6-Week Programme will be clearly displayed at the time of purchase.
Â
Unless otherwise stated, payment must be made in full before the personalised programme is created and coaching services begin.
Â
Payments made through the Silverback Muscle website are processed using Wix Payments. Payment processing may also be subject to the applicable terms and privacy practices of Wix and its payment services.
Â
Silverback Muscle does not ordinarily receive or store a client's full payment-card details when payments are processed by Wix Payments.
Â
Promotional, introductory or Founding Member pricing applies only under the conditions stated with the relevant offer and does not guarantee the same price for future programmes or services.
Â
Your Right to Cancel
Â
Where applicable under UK consumer law, customers purchasing the service online will normally have a legal right to cancel the contract within 14 days without giving a reason.
Â
The cancellation period begins on the day after the contract is entered into.
Â
To exercise your right to cancel, you must clearly inform Silverback Muscle of your decision within the applicable cancellation period. You may contact Silverback Muscle at contact@silverbackmuscle.com.
Â
Starting Your Programme During the Cancellation Period
Â
You may expressly request that Silverback Muscle begins providing the service before the 14-day cancellation period has ended.
Â
This may include reviewing your questionnaire, creating your personalised programme, setting up your coaching service and beginning coaching support.
Â
Where you expressly request that services begin during the cancellation period and subsequently cancel before the service has been fully performed, you may be required to pay an amount proportionate to the services already provided up to the point at which you informed us of your cancellation.
Â
Where the service has been fully performed during the cancellation period following your express request to begin the service and your acknowledgement that you will lose your cancellation right once the service has been fully performed, your statutory right to cancel may no longer apply.
Â
Nothing in these Terms affects your statutory consumer rights.
Â
After the Cancellation Period
Â
After the applicable statutory cancellation period has expired, refunds are not automatically provided because a client changes their mind, chooses not to complete the programme or does not use the coaching service.
Â
This does not affect any rights you may have where the service has not been provided with reasonable care and skill or where you otherwise have a legal right to a remedy.
Â
Missed Workouts and Check-Ins
Â
Refunds will not normally be provided because a client has missed workouts, failed to complete check-ins, stopped using the programme or decided not to continue training.
Â
Where exceptional circumstances prevent a client from continuing, Silverback Muscle may consider an appropriate solution on a case-by-case basis.
Â
4. Health, Medical & Exercise Safety
Â
Your Health and Readiness to Exercise
Â
By participating in a Silverback Muscle programme, you confirm that you are physically able to take part in resistance training and exercise.
Â
You are responsible for providing accurate and relevant information about injuries, physical limitations or other circumstances that may affect your ability to exercise safely.
Â
If you have concerns about whether exercise is suitable for you, you should seek appropriate advice from a qualified healthcare professional before beginning the programme.
Â
Medical Conditions and Injuries
Â
Silverback Muscle does not provide medical advice, diagnosis, treatment, physiotherapy or rehabilitation services.
Â
Information provided through Silverback Muscle should not be used as a substitute for advice from an appropriately qualified healthcare professional.
Â
If you experience pain, dizziness, faintness, unusual shortness of breath, chest pain or other concerning symptoms while exercising, stop exercising and seek appropriate medical attention.
Â
Relevant changes in your health or injuries that could affect your programme should be communicated to Silverback Muscle.
Â
Exercise Risk
Â
Resistance training and physical exercise involve an inherent risk of injury.
Â
Clients are responsible for exercising safely, using appropriate equipment, selecting suitable training loads and following reasonable exercise instructions.
Â
You should not attempt an exercise, load or technique that you do not feel able to perform safely.
Â
Training Environment and Equipment
Â
Clients are responsible for ensuring that the equipment and training environment they use are reasonably safe and suitable.
Â
Silverback Muscle is not responsible for the condition or maintenance of equipment supplied by gyms, training facilities or other third parties.
Â
5. Nutrition & Lifestyle Guidance
Â
Silverback Muscle may provide general information relating to nutrition, hydration, protein intake, recovery, sleep and other lifestyle factors that may support training and fitness goals.
Â
Nutrition information is provided for general fitness and educational purposes and is not intended to diagnose, treat or manage a medical condition.
Â
Silverback Muscle does not provide medical nutrition therapy or prescribe diets for the treatment or management of medical conditions.
Â
Clients are responsible for considering their own dietary requirements, allergies, intolerances, medical circumstances and professional advice they have received.
Â
Where appropriate, clients should seek advice from a registered dietitian or other suitably qualified healthcare professional.
Â
Supplements
Â
Silverback Muscle may provide general educational information about commonly used sports and fitness supplements.
Â
The decision to use a supplement remains the responsibility of the client. Clients should check ingredients, instructions, warnings and suitability before use and seek appropriate professional advice where necessary.
Â
Silverback Muscle does not guarantee the safety, effectiveness or suitability of a particular supplement for an individual client.
Â
6. Client Responsibilities & Programme Participation
Â
Clients are responsible for providing complete and accurate information during onboarding and throughout the programme.
Â
Clients should make a reasonable effort to follow their prescribed programme safely and provide sufficient information during check-ins for coaching and programme adjustments to be provided effectively.
Â
Clients should raise questions or concerns as soon as reasonably possible.
Â
If an exercise or instruction is unclear, clients should request clarification rather than undertaking something they believe may be unsafe.
Â
Individual training results cannot be guaranteed. Results may be influenced by factors including consistency, effort, nutrition, recovery, sleep, lifestyle and individual differences.
Â
Failure to complete workouts, submit check-ins, record training information or otherwise participate in the programme does not automatically entitle a client to a refund or extension.
Â
7. Coaching App, Technology & Availability
Â
Silverback Muscle currently uses Everfit as its coaching platform to deliver and manage aspects of the Silverback Muscle coaching service.
Â
Clients may be required to create an Everfit account and use the Everfit app or platform to access their programme, record workouts, submit information, track progress and communicate in connection with their coaching.
Â
Use of Everfit may also be subject to Everfit's own applicable terms and privacy practices.
Â
Clients are responsible for having a compatible device and suitable internet connection and for keeping their account credentials secure.
Â
Silverback Muscle cannot guarantee that Everfit or other third-party digital services will operate without interruption or technical problems at all times.
Â
Where a technical problem prevents access to the programme, clients should notify Silverback Muscle at contact@silverbackmuscle.com. Reasonable steps will be taken to help restore access or provide relevant programme information through an alternative method where appropriate.
Â
Silverback Muscle may change the application, platform or digital method used to deliver its services where reasonably necessary, provided that doing so does not materially reduce an active client's purchased service.
Â
8. Intellectual Property & Programme Materials
Â
Unless otherwise stated, original content and materials created and provided by Silverback Muscle remain the intellectual property of Silverback Muscle or the relevant rights holder.
Â
This may include training programmes, programme structures, coaching materials, guides, educational content, graphics, branding, logos and videos.
Â
Purchasing a programme grants the client a limited, non-exclusive and non-transferable right to use the programme and associated materials for their own personal training purposes.
Â
Unless permitted by law or prior written permission has been obtained, clients must not sell, resell, commercially reproduce or redistribute Silverback Muscle programme materials; share personalised programmes for another person to use as their own; publish substantial programme materials online; or represent Silverback Muscle materials as their own work.
Â
Content supplied through Everfit or another third-party service that is owned or licensed by that provider or another rights holder remains subject to the intellectual property rights and applicable terms of the relevant owner.
Â
9. Pausing, Extending or Ending a Programme
Â
The Silverback Muscle 6-Week Programme runs for six consecutive weeks from the agreed start date unless an alternative arrangement has been agreed.
Â
The programme does not automatically pause or extend because of missed workouts, check-ins, holidays, work commitments or other periods of non-participation.
Â
Where illness, injury or another significant unforeseen circumstance prevents a client from continuing, they should contact Silverback Muscle as soon as reasonably possible.
Â
Where appropriate, Silverback Muscle may agree to pause the programme, adjust training or extend the coaching period for a reasonable period. Such arrangements will be considered on a case-by-case basis.
Â
A client may stop participating at any time, but choosing to stop does not automatically create a right to a refund.
Â
Silverback Muscle may suspend or end coaching where there is a reasonable and proportionate reason, including serious or repeated abusive or threatening behaviour, deliberate misuse of the service, or circumstances where continuing coaching would be inappropriate or unsafe.
Â
Where Silverback Muscle ends a programme for reasons not caused by the client's conduct or breach of these Terms, an appropriate remedy may be provided for services paid for but not supplied where applicable.
Â
10. Silverback Muscle Coaching Guarantee
Â
Silverback Muscle is committed to providing a personalised programme and coaching service that reflects the information provided during onboarding and the services described at the time of purchase.
Â
If you believe the service received does not reasonably reflect what was promised, contact Silverback Muscle as soon as possible at contact@silverbackmuscle.com.
Â
Where there is a genuine issue, Silverback Muscle will take reasonable steps to put it right.
Â
Depending on the circumstances, this may include reviewing or adjusting the programme, providing additional coaching support, correcting an issue or providing another appropriate remedy.
Â
When considering a claim under the coaching guarantee, Silverback Muscle may take into account whether the client has provided accurate onboarding information, made a reasonable effort to follow the programme, participated in check-ins, provided sufficient training information and given Silverback Muscle a reasonable opportunity to address the concern.
Â
The guarantee does not promise a particular increase in muscle mass, strength, body weight, body composition or other physical result.
Â
The guarantee is provided in addition to, and does not replace or limit, the client's statutory consumer rights.
Â
11. Liability & Events Outside Our Control
Â
Silverback Muscle will provide its coaching services with reasonable care and skill.
Â
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Â
Clients are responsible for following their programme safely and considering their abilities, circumstances and training environment.
Â
Silverback Muscle will not be responsible for loss or injury arising solely from a client's failure to follow reasonable safety instructions, deliberate misuse of equipment or failure to disclose information reasonably required to provide the service safely.
Â
This does not exclude responsibility where loss or injury results from Silverback Muscle's negligence or another matter for which liability cannot legally be excluded.
Â
Silverback Muscle is not responsible for losses that could not reasonably have been foreseen when the contract was entered into.
Â
Where events outside Silverback Muscle's reasonable control materially affect an active programme, reasonable steps will be taken to minimise disruption.
Â
Where a significant disruption prevents a substantial part of the purchased service from being provided, an appropriate alternative arrangement or remedy will be considered in accordance with the circumstances and the client's legal rights.
Â
12. Privacy & Personal Information
Â
Silverback Muscle may collect and use personal information required to provide its coaching services.
Â
This may include contact information, training goals, experience, programme preferences, progress information and information supplied during onboarding, check-ins or communications.
Â
Where relevant to providing the service safely, clients may also provide information relating to injuries, physical limitations or other health-related circumstances.
Â
Personal information may be used to create and deliver programmes, provide coaching support, review progress, make programme adjustments, communicate with clients, administer purchases and meet applicable legal requirements.
Â
Silverback Muscle uses third-party services in connection with the operation and delivery of its services. These currently include Wix for the Silverback Muscle website and related website services, Wix Payments for payment processing, and Everfit for coaching programme delivery and management.
Â
These providers may process personal information where necessary to provide their respective services and may have their own applicable privacy terms.
Â
Further information about how Silverback Muscle collects, uses, stores and protects personal information, including information about relevant service providers and clients' data protection rights, is provided in the Silverback Muscle Privacy Policy.
Â
13. Changes to the Service & These Terms
Â
Silverback Muscle may update or change aspects of its services from time to time, including delivery methods, coaching platforms, processes and programme features.
Â
Changes made during an active programme will not materially reduce the core service already purchased without an appropriate reason or agreement.
Â
Silverback Muscle may change its prices for future purchases. Price changes will not affect a programme that has already been purchased and paid for unless otherwise agreed.
Â
Promotional, introductory or Founding Member pricing may be changed or withdrawn for future purchases.
Â
These Terms and Conditions may also be updated to reflect changes to services, business practices, technology or applicable legal requirements.
Â
The Terms applying to a purchase will generally be those provided or made available when the contract was entered into.
Â
The latest version will be made available on the Silverback Muscle website and will display its last updated date.
Â
14. Complaints & Resolving Problems
Â
Silverback Muscle aims to provide a high standard of service and deal with client concerns fairly.
Â
If you are unhappy with an aspect of your programme or coaching service, please contact Silverback Muscle as soon as reasonably possible at contact@silverbackmuscle.com and explain the issue.
Â
Silverback Muscle will review the concern and take reasonable steps to resolve genuine problems.
Â
Depending on the circumstances, this may include reviewing the programme, correcting an error, making an appropriate adjustment, providing additional support or another suitable remedy.
Â
Please provide sufficient information for the issue to be understood and investigated.
Â
Nothing in this complaints procedure affects your statutory consumer rights or prevents you from pursuing other remedies available under applicable law.
Â
15. Governing Law & General Terms
Â
These Terms and Conditions and contracts between clients and Silverback Muscle are governed by the laws of England and Wales.
Â
Consumers elsewhere in the United Kingdom may also benefit from mandatory protections provided by the law applicable where they live.
Â
Nothing in these Terms affects statutory consumer rights.
Â
If a dispute cannot be resolved directly, either party may pursue rights or remedies available under applicable law.
Â
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Â
If Silverback Muscle does not immediately enforce a right under these Terms, this does not necessarily mean that right has been waived.
Â
Unless otherwise required by law, these Terms are between the client and Silverback Muscle and are not intended to give another person a right to enforce them.
